Klinik Farma – The Civil Society Coalition for Security Reform approached the Coordinating Ministry for Political, Legal and Security Affairs (Kemenko Polhukam) to send a letter demanding a promise to revise Law No. 31 of 1997 on military justice.
Andrie Yunus, Acting Head of the KontraS Legal Department, a spokesman for the Civil Society Coalition, said they made the pledge following statements by Coordinating Minister for Political, Legal and Security Affairs Mahfoud M.D. and Vice President Maruf Amin, who said the government was open and ready to revise the Military Justice Law.
The announcement was made by Marouf and Mahfoud, MD, in response to a corruption controversy involving Basarnas aide Marshal Henri Alfiandi.
“Our intention and purpose in our today’s activities, firstly, today we are sending an open letter regarding the pressure to immediately revise Law No. 31 of 1997 on military justice,” Andrie said during a meeting with journalists at the office of the Coordinating Ministry. Political, Legal and Security Affairs, Jakarta, Wednesday (August 16, 2023).

They hope that the corruption case that imprisoned Marshal Henri Alfiandi, who is none other than a member of the TNI, will be the impetus for an immediate review of the Military Justice Law.
Andri believes that Henri Alfiandi should be judged by a general court, not a military court. This is because the alleged corruption took place in Basarnas, which is a civilian institution and not a military one.
“From the trial of the head of Basarnas, which attracted public attention, that, in our opinion, military personnel who commit ordinary crimes are not military crimes, they are not tried in military courts. justice for military courts, especially when crimes are committed. general,” he said.
They also asked the DPR RI to immediately discuss the revision of the Law No. 31 of 1997 “On Military Justice” in accordance with their powers.
“We also call on the DPR, especially the government, to discuss immediately through legislation to improve the entire structure of military justice,” Andrie said.
