Jakarta, Klinik Farma – Coordinating Minister for Policy, Law and Human Rights (Menko Polhukam) Mahfud MD responded to a question about the Sultan Hotel land dispute in Gelora Bung Karno (GBK), Senayan, Jakarta. This became known at a coordination meeting on Friday (08/09/2023).
The land in dispute was the disputed land plot of the 15th block of the GBK, on which the Sultan Hotel currently stands. This land is managed by PT Indobuildco until the Building Use Rights (HGB) expire and the land finally returns to government hands.
PontjoSutowo filed several lawsuits demanding an extension of management rights. Finally, Ponjo Sutovo, in his capacity as President Director of Indobuildco, filed a claim with PTUN on February 28, 2023 regarding land use rights in the Senayan area where the Sultan Hotel is located. It was this lawsuit that was filed by one of the Ministers of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN) Hadi Tjahjanto.
This land is a state asset, or more precisely, its ownership status is now under the jurisdiction of the State Secretariat of the Ministry (Kemensetneg). He therefore asked PT Indobuildco to vacate the area.
“We hope that he will be released properly, and later the release process will be carried out, of course, through convincing law enforcement agencies,” he said, quoting a statement from the Ministry of ATR/BPN, Jakarta, Friday (8/9/). 2023).
Mahfud said he respects the latest lawsuit filed by Indobuildco with PTUN. However, he considered this step a waste of time. Especially considering that the company owned by Ponjo Sutovo filed civil lawsuits several times and was declared lost.
“PC up to 4 times, they lost. That this land is a state asset, the State Secretariat, they lost, and time has passed. Having lost in civil law, they are now again going to PTUN for a new claim, they We have lost so many times that this is already impossible.”I’m back at PTUN,” Mahfud said.
“Brothers and sisters, we believe that let the PTUN case continue because the civil case is over. And in our legal logical mind, of course, PTUN is the same thing, a waste of time, a waste of time, like the previous one,” he said.
Minister of Agricultural Affairs and Spatial Planning or head of the National Land Agency (BPN) Hadi Tjahjanto stressed that the original owner of the land, in this case Indobuildco, no longer has rights to the land. This is based on the expiration of the land management permit Ex HGB No. 26/Gelora and HGB No. 27/Gelora on behalf of Indobuildco on March 3 and April 3 this year.
“It’s September now. This means that the status of HGB No. 6 and 27 expired a few months ago. It automatically reverts to HPL No. 1 of 89, the legal status of which is registered in the name of the Secretariat of State. any problems with HGB above. HPL,” he explained.
